Working Group Legal Opinions

(BMF Membership Code: 3) Chicago Real Estate Partner Kenneth Jacobson will participate as a panelist at a Legal Opinion Working Group (WGLO) meeting entitled « A National Opinion Practice: How Far We Have Come and Next Steps » on October 30, 2018. The session will focus on reviewing legal developments over the past 20 years with respect to national advisory practice, including advances in legal advice practice and next steps. Serve as an organizational framework for Council members to assist each other in opinion reports, educational programs and other efforts that contribute to the common understanding of current practice in legal advice and its application in general and specific contexts. The WGAD issues approximately 70-90 opinions per year, all of which are adopted at its meetings. In each opinion that is a public document (once adopted), the WGAD considers whether it constitutes arbitrary detention and, if so, classifies the situation into one or more of the five categories. It recommends that the State take appropriate measures (usually the release of the person) and may also require reparations (e.g. compensation) and guarantees of non-repetition.

The Legal Advice Working Group provides a national forum to discuss key issues related to final opinions. Participants in the Legal Advice Working Group include opinion makers, opinion beneficiaries, the ABA, state and local bar associations, as well as rating agencies and law firm insurers.
